HABEAS CORPUS APPEAL HEARING – Court cannot interfere in the ISA
The court cannot
interfere in the Internal Security Act (ISA) argued the prosecution
at the continuation of the Habeas Corpus appeal hearing in the Kuala
Lumpur Federal Court today.
The court cannot
question any arrest under the ISA the prosecution explained. The
arrest is made based on the belief that the person arrested may
act prejudicial to the security of the nation.
This belief,
in turn, is based on the assumption that there is a probability
the person arrested may sometime in the future commit such an act
and the court may not interfere or question whether there were enough
grounds for this arrest.
The Minister
just has to have reason to believe that the person may commit an
act prejudicial to the security of the nation though it may not
have been committed yet. And he need produce any evidence to support
this belief.
